1. Introduction
These Terms & Conditions ("Terms") govern your use of Casa360's website and any purchases made through it. By accessing or using our services, you agree to be bound by these Terms.
1.1 Applicability
These Terms apply to all products, services, orders, and transactions conducted with Casa360. By placing an order, you confirm agreement to these Terms. If you disagree with any part, kindly refrain from using our site or ordering from us.
1.2 Entire Agreement
These Terms constitute the full agreement between you and Casa360, superseding any prior correspondence. Any other terms or conditions proposed by you—even if included in your purchase order—are expressly rejected unless independently agreed in writing.
2. Products & Ordering
2.1 Product Descriptions
We attempt to ensure accuracy in product details, images, and pricing. However, minor variations may occur due to screen settings or natural product differences. Size difference may also occur as mostly our product is handmade. Casa360 retains the right to correct errors or to adjust or update information without notice.
2.2 Order Acceptance
Orders are accepted once payment is received and a confirmation email is dispatched. Casa360 reserves the right to decline any order—for instance, due to pricing errors, stock unavailability, or suspicion of fraudulent activity.
2.3 Stock & Availability
All orders are subject to product availability. Discontinued or out-of-stock items may result in order cancellation, with a full refund issued or substituted options proposed.
3. Pricing, Payment & Taxes
3.1 Pricing
Prices are listed in INR (or your applicable currency) and include applicable taxes and shipping, unless otherwise specified. Prices may change at any time without prior notice.
3.2 Payment Terms
Full payment is required at the time of order through accepted methods such as credit/debit cards, UPI, net banking, or other specified gateways. For registered business or bulk orders, Casa360 may offer Net-30 terms upon approval. Pre-payment is mandatory for new accounts.
3.3 Taxes
Clients are responsible for all applicable sales, GST, or usage taxes. Casa360 will itemize such taxes on your invoice. If you qualify for tax exemption, a valid certificate must be provided prior to purchase.
4. Shipping & Delivery
4.1 Logistics
Casa360 handles delivery logistics.
4.2 Delivery Timeline
Estimated delivery dates are provided, but delays may occur due to factors beyond our control. Casa360 is not liable for delays not caused by negligence or breach of contract.
4.3 Inspection
Please inspect and record goods promptly upon delivery. Any visible damage or missing parts must be reported to Casa360 within 48 hours for resolution.
5. Returns, Cancellations & Refunds
5.1 Cancellation Policy
You may cancel standard-stock orders within 48 hours of order confirmation for a full refund. Orders confirmed beyond this window or custom-made pieces may incur cancellation fees (100%) or be non-cancellable.
5.2 Return Policy
Returns are accepted only for defective or incorrect products, and only within a specified timeframe (4 days after delivery) if unused and in original condition only. Custom, made-to-order, or personalized items are non-returnable once production begins.
5.3 Refunds
Refunds for valid returns or cancellations will be processed through the original payment method within 7-10 business days.
6. Intellectual Property & Use of Content
6.1 Ownership & License
All content on Casa360—images, text, logos, designs—is owned or licensed by us. You may view and print pages for personal use only. Any other use is strictly prohibited without written consent.
6.2 User Content
If you submit reviews or images, you grant Casa360 a non-exclusive, worldwide, royalty-free, irrevocable license to use, reproduce, adapt, publish, and distribute it. Casa360 reserves the right to remove any content that violates rights or is inappropriate.
7. Warranties & Liability
7.1 Warranty
Products are warranted for defects in materials or workmanship for a specified period (1 year). Warranty covers repair or replacement only and excludes wear from normal use, misuse, or unauthorized changes.
7.2 Limitation of Liability
Casa360 is not liable for incidental or consequential damages—this includes loss of profit, business interruption, or property damage—arising from product use or delivery. Our aggregate liability is limited to the value of the purchase. Some jurisdictions may not allow such limitations.
8. Indemnification & Dispute Resolution
8.1 Indemnity
You agree to indemnify Casa360 and its agents from any claims arising from your misuse of products, breach of these Terms, or infringement of third-party rights.
8.2 Governing Law & Jurisdiction
These Terms are governed by Indian law, and disputes will be resolved exclusively in courts located in Jaipur, India, unless otherwise agreed.
9. Force Majeure
Casa360 is not liable for delays or non-performance caused by circumstances beyond our control, including natural disasters, strikes, pandemics, or supply-chain disruptions.
10. Modifications to Terms
Casa360 may update these Terms at any time. Updates will be posted on our website with the effective date indicated. Continued use of the site after changes constitutes acceptance of the new Terms.
